ALL ITEMS MUST BE PAID FOR BY CONCLUSION OF SALE & INVOICING by way of Visa, MasterCard or othe MAJOR CREDIT CARD. We will only charge the credit card used upon registration. Hewlett’s will invoice you via Proxibid at the conclusion of sale. On Monday your credit card will be charged for your purchases, plus buyer’s premium (16.5%) and sales tax if it applies. No sales tax applies when items are shipped out of California. Credit card charge backs will not be accepted. Onsite premiums and discounts to not apply to online bidders.

All merchandise is sold “as is”, while descriptions and conditions are believed to be correct there is no guarantee. We will be happy to go over every lot with you and send any additional photos, but foremost we encourage you to resolve all your concerns prior to executing your bids. Shipping cost will be paid separately (see shipping & handling instructions). All items will be transported to our preferred shipper at no charge to you. Any variation of shipping, transport or payment must have approval by the management of Hewlett’s Auctions 3 days prior to sale.

Buy making application to bid you understand all Terms & Conditions of Sale and that you agree to pay for all merchandise purchased under this application by end of sale day. Silent or Absentee bidders will need to provide Hewlett's with a current major credit card to register on line.
If you are interested in bidding on an item and can't attend an auction in person, you can complete a Absentee Form and submit by Email or Fax. We will bid on the item on your behalf. All bids must be received by 6pm on the day prior to auction. We will confirm your bid by email or phone. If you have not received confirmation by 9 am the following day, please call our offices at 209-389-4542. Phone lines are limited to major items that will have a minimum opening bid greater than $500.00 or the combination thereof.
Phone Bid
Phone bidding is reserved for items of high interest and value. If you are interested in phone bidding on items in a particular auction please contact us immediately to reserve your phone line. Once the lines are all promised we will either put you on a will call or place a silent bid for you at your discretion.

| CONSIGNMENT
Hewlett's can consign a single item or whole estate. As Consignor you commission Hewletts to sell the items to the highest bidder by public auction. Consignors must guarantee that they are in fact the owner of the property and have title the right to sell and that all items are free from any incumbrances. The Consignor can provide delivery to Hewlett's or we can make arrangements for pickup. We have the wrapping, containers and staff to handle the largest and the most delicate of items. With years of experience in shipping and packing from the East to the West coast, we have learned a few tricks. Most important is that we see the merchandise and meet with you to determine what your needs are and how best we can serve you. We offer this to you at no charge for CONSULTATION.
Reasonable fees. Our consignment fees and buyer's premiums are among the lowest in the industry.
SIMPLE CONTRACT
Hewlett's documents, tags and itemizes all merchandise from home, warehouse or storage at an agreed to commission, no separate or hidden fees for advertizement, photography, storage or insurance.
All agreements and conditions must be in writing and signed by both parties.

TERMS & CONDITIONS OF A WINNING BID
By submitting a bid, the BUYER hereby consents to all of the terms and conditions set forth herein. The obligation to pay for items for which the BUYER was the successful bidder is absolute at the time of the fall of the hammer and is not conditional on inspection or appraisal of the items purchased. The BUYER bears the risk of all patent and latent defects, whether or not apprised of such by Hewlett Auctions or consignor. All items are sold as-is, where-is with no exceptions. The auctioneer will acknowledge the high bidder of each lot and will be sole judge of the purchaser of each item. In the case of duplicate left bids the one received first will have preference? The Buyer assumes full responsibility for items at the fall of the hammer. The record of sale kept by the auction house will be taken as final in the event of any dispute. Unless other arrangements have been make with the auction house, all phone bids will require a deposit set forth by the auction company. Hewlett’s Auctions will not be responsible for failure to execute left or phone bids. There is a buyer’s premium of 12.5% floor or 15% live added to the hammer price of each lot and it will be considered part of the total purchase price. All buyers will be subject to California sales tax unless the buyer possesses a valid tax-exempt. Reseller’s number or in the case of a purchase from outside of California. Hewlett’s Auctions reserves the right to hold property until checks clear. Buyers intending to purchase expensive items should discuss payment prior to day of sale. Arrangements for shipping and storage should be made prior to the auction and will be at the Purchaser’s expense. The BUYER hereby agrees that Hewlett’s Auction is entitled to recover one to three times the written check amount, attorney’s fees and costs of collection from the BUYER in the event that the BUYER fails or refuses to pay in full for items for which the purchaser was the high bidder.
Hewlett’s Auction may in its sole discretion waive any term(s) of these Terms and Condition of Sale to any party at any time without notice to the purchaser. The BUYER agrees that Hewlett’s Antique Auctions shall not be liable for the waiver of any term hereof to any party.
The purchaser is bound by these terms and conditions of sale by participating in any auction held by Hewlett’s Antique Auctions.
Auctioneer's announcements will take precedence over any printed material.
